アプリ規約

この利用規約（以下「本規約」）は、カラクリワークス株式会社（以下「当社」）が提供するスマートフォンアプリ「味憶」（iOS版・Android版を含み、以下「本アプリ」）の利用条件を定めるものです。本アプリをご利用いただく際には、本規約に同意いただいたものとみなします。

第1条（本アプリの内容）

本アプリは、家庭料理のレシピを写真と音声テキストで記録し、PDF等の形式で書き出し、また本アプリの利用者同士でレシピを送り合うことができるサービスです。

第2条（アカウント登録）

  1. 本アプリの利用には、メールアドレスまたはGoogleアカウント等によるアカウント登録が必要です。
  2. 登録情報は正確な内容で登録し、変更があった場合は速やかに更新してください。
  3. アカウントの認証情報（パスワード等）は利用者の責任で管理してください。第三者による不正利用について、当社の故意または過失による場合を除き、当社は責任を負いません。
  4. 未成年の方は、保護者の同意を得たうえでご利用ください。

第3条（利用料金・サブスクリプション）

  1. 本アプリは無料でご利用いただけます。ただし、無料版では作成できる味憶（レシピ）の件数・手順数等に制限があります。
  2. 有料プラン「味憶プレミアム」（月額100円。実際の請求額はApp StoreまたはGoogle Playの表示に従います）に加入すると、制限が解除され、レシピを他の利用者へ送る機能が利用できます。
  3. プレミアムは自動更新のサブスクリプションです。期間終了の24時間前までに解約手続きを行わない限り、自動的に更新されます。
  4. 購入・解約・返金は、App StoreまたはGoogle Playの定める手続き・ポリシーに従います。当社が独自に返金を行うことはできません。

第4条（コンテンツの権利と取り扱い）

  1. 利用者が本アプリで作成したレシピ・写真・テキスト等（以下「ユーザーコンテンツ」）の権利は、利用者に帰属します。
  2. ユーザーコンテンツは原則として利用者の端末内に保存されます。「味憶を送る」機能を使用した場合に限り、送信に必要な範囲でユーザーコンテンツが当社の管理するサーバーを経由し、受信者に届けられます。
  3. 送信されたユーザーコンテンツは受信者の環境に保存されるため、送信後に利用者側で削除しても、受信者側からは削除されません。送信先はご自身の責任でご確認ください。

第5条（禁止事項）

利用者は、本アプリの利用にあたり、次の行為をしてはなりません。

  • 法令または公序良俗に違反する行為
  • 第三者の著作権・肖像権・プライバシーその他の権利を侵害するコンテンツの記録・送信
  • 他の利用者への嫌がらせ、迷惑となるコンテンツの送信
  • 本アプリの不正利用、リバースエンジニアリング、サーバーへの不正アクセス
  • その他、当社が不適切と判断する行為

第6条（データの保全について）

  1. ユーザーコンテンツは利用者の端末内に保存されます。端末の故障・紛失・機種変更・アプリの削除等によりユーザーコンテンツが失われた場合、当社はこれを復元できません。
  2. 大切な記録は、PDF書き出し等の機能を利用してご自身でバックアップされることをおすすめします。

第7条（アカウントの削除）

  1. 利用者は、アプリ内の操作でいつでもアカウントを削除できます。手順は当社ウェブサイトの「アカウント削除の手順」ページをご参照ください。
  2. アカウントを削除すると、認証情報・受信ボックス等のサーバー上のデータおよび端末内のレシピデータが削除されます。削除されたデータは復元できません。

第8条（個人情報の取り扱い）

当社は、利用者の個人情報を当社のプライバシーポリシーに従って取り扱います。

第9条（サービスの変更・中断・終了）

  1. 当社は、利用者への事前の通知のうえ、本アプリの内容の変更、提供の中断または終了を行うことがあります。ただし、緊急やむを得ない場合は事前の通知を行わないことがあります。
  2. 本アプリの提供終了に伴い利用者に生じた損害について、当社の故意または重過失による場合を除き、当社は責任を負いません。

第10条（免責事項）

  1. 当社は、本アプリが利用者の特定の目的に適合すること、期待する機能・正確性・有用性を有すること、および不具合が生じないことを保証しません。
  2. 音声のテキスト変換は端末の音声認識機能を利用しており、変換結果の正確性は保証されません。
  3. 本アプリの利用に関連して利用者に生じた損害について、当社の故意または重過失による場合を除き、当社の賠償責任は、当該利用者が過去12か月間に当社に支払った利用料金の総額を上限とします。

第11条（本規約の変更）

当社は、必要と判断した場合、本規約を変更することがあります。重要な変更を行う場合は、本アプリ内またはウェブサイト上で事前にお知らせします。変更後に本アプリの利用を継続した場合、変更後の規約に同意したものとみなします。

第12条（準拠法・管轄裁判所）

本規約は日本法に準拠し、本アプリに関して紛争が生じた場合、福岡地方裁判所を第一審の専属的合意管轄裁判所とします。

Mioku App – Terms of Use

This English translation is provided for reference. In the event of any discrepancy, the Japanese version shall prevail.

These Terms of Use ("Terms") govern your use of the mobile application "Mioku" (iOS and Android; the "App") provided by Caracri Works Inc. ("we/us"). By using the App, you agree to these Terms.

1. The App

Mioku lets you record home-cooking recipes with photos and voice-transcribed text, export them as PDF and other formats, and send recipes to other Mioku users.

2. Account

Registration with an email address or Google account is required. Keep your registration information accurate and your credentials secure. Except in cases of our willful misconduct or negligence, we are not responsible for unauthorized use of your account. Minors should use the App with parental consent.

3. Fees & Subscription

The App is free to use with limits (number of recipes and steps). "Mioku Premium" (monthly; the actual price is shown in the App Store / Google Play, e.g., $0.99/month) removes the limits and enables sending recipes. The subscription renews automatically unless canceled at least 24 hours before the end of the period. Purchases, cancellations, and refunds follow the policies of the App Store / Google Play.

4. Your Content

You retain the rights to the recipes, photos, and text you create. Your content is stored on your device by default; only when you use "Send Recipe" is it transmitted via our servers to the recipient. Content already delivered to a recipient is not removed by deleting it on your side — please confirm recipients carefully.

5. Prohibited Conduct

Do not use the App to violate laws or the rights of others (including copyright, portrait rights, and privacy), to harass other users, or to attempt unauthorized access or reverse engineering.

6. Data Preservation

Your content is stored on your device. We cannot restore content lost due to device failure, loss, replacement, or deletion of the App. We recommend backing up important records using the PDF export feature.

7. Account Deletion

You can delete your account at any time from within the App (see our "How to Delete Your Account" page). Deletion removes your server-side data (authentication and inbox) and on-device recipe data, and cannot be undone.

8. Privacy

We handle personal information in accordance with our Privacy Policy.

9. Changes to the Service

We may change, suspend, or terminate the App with prior notice (or without, in urgent cases). Except in cases of our willful misconduct or gross negligence, we are not liable for damages arising from termination.

10. Disclaimer

The App is provided "as is." Voice transcription relies on your device's speech recognition and its accuracy is not guaranteed. Except in cases of our willful misconduct or gross negligence, our total liability is limited to the fees you paid us in the preceding 12 months.

11. Amendments

We may amend these Terms with prior notice of material changes in the App or on our website. Continued use constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of Japan. The Fukuoka District Court shall have exclusive jurisdiction as the court of first instance.
